High Court Dismisses BSP's Appeal To Freeze The Merger Of 6 ex MLA's With Ashok Gehlot Govt
New Delhi: The BSP appeal seeking a freeze on the merger of its six former legislators with the Ashok Gehlot Congress government was today dismissed by the High Court today, which left the decision to the single bench that is hearing the case.
The decision will have implications for the government that is struggling to hold the majority in the face of the rebellion by Sachin Pilot and his 18 loyalist MLAs.
Updates in the story:
1-Ashok Gehlot's number will drop from 102 to 96 without the former BSP men. With the rebel camp and three independents MLAs, the number of the other side will touch 97.Form the current mark 101 the halfway mark in the assembly will also come down to 97.
2- Challenging speaker decision the BSP and BJP had gone to court in September 2019 allowing the merger of the six BSP MLAs with congress.
3. However, a single bench judge of the High Court refused to stop the functioning of the BSP MLAs as Congress legislator even an interim measure.
4. The court yesterday issued notice to Speaker CP Joshi after BSP national secretary Satish Mishra and BJP MLA Madan Dilawar appealed for an interim freeze.
5- In the house proceedings the parties had demanded a stay on the participations of six MLAs crucial if the Ashok Gehlot government has to take a trust vote
6- Six BSP MLAsSandeep Yadav, Wajib Ali, Deepchand Kheria, Lakhan Meena, Jogendra Awana, and Rajendra Gudha had defeated the Congress in September last year, helping the Congress which won 100 seats raises it to tally
7-"BSP could have gone to the court earlier too but we were looking for a time to teach the Congress party and Chief Minister Ashok Gehlot a lesson. Now we have decided to go to the Court. We will not let this matter alone. We will go even to the Supreme Court," Mayawati had said.
8- BSP Chief Mayawati following the rebellion of Sachin Pilot and his loyalist MLAs who had been livid with the defection and was waiting for an opportune moment, said she wants to "teach the Ashok Gehlot government a lesson".
9-The court, for now, has ordered a status quo. The disqualification of the rebel, who has broken ranks with the party, will bring down the number in 200 member assembly.
10- The rebel MLA have also challenged the speaker's decision to disqualify them
