New Delhi: On Monday the Top Court told to the Uttar Pradesh government that it can't spare a sitting top court judge for the inquiry and asked the Yogi administration to consider adding a former apex court judge and a retired police officer in the inquiry committee which is probing the encounter of the gangster Vikas Dubey.
The Supreme Court also said that it was "appalled" that the gangster got bail despite so many cases against him.
The bench headed by the Chief Justice SA Bobde hearing a batch of a plea seeking court-monitored probe into the encounter of Dubey and his alleged associates told to the Uttar Pradesh government that they have to "uphold rule of the law"
The top court said that "You as a state have to uphold the rule of law. It is your duty to do so".The bench said that it cannot spare a sitting top court judge to become a part of the inquiry committee.
Appearing for the Uttar Pradesh Solicitor General Tushar Mehta, sought some time to take instruction and get back to the court on the issue.“We are appalled to the fact that a person like Vikas Vikas Dubey got the bail despite so many cases,” the bench said.
“This is the failure of the institution and the person, who should have been behind the bars, got bail,” the bench observed during the hearing which is going on.
Gangster Vikas Dubey was shot dead while trying to escape after the car accident, the UP Cops had announced on July 10, a day after his dramatic arrest in the Madhya Pradesh. As per the police, Vikas Dubey snatched the gun of the policeman and has opened fire, said the police asserting that they had tried to catch him alive.
